The evolving complexities in risk and clinical liability - indemnity for new care models

Initiatives to transform the NHS and introduce new care models are providing new opportunities for GPs, consultants and other healthcare professionals to offer their services in innovative ways through organisation structures including multi-speciality community providers, federations and enhanced health in care homes. 

While these developments may significantly change and improve the care provided to communities, they also create the need for new and bespoke corporate indemnity arrangements whilst maintaining medico-legal support for individual medical professionals.

Learning objectives:

  • Discuss the recent changes to claims procedures in England and examine their effect on claims today.
  • Identify the factors driving the spiralling cost of claims.
  • Apply key elements in complaints governance with patient safety incidents in complex care organisations.
  • Recognise the wider ramifications of medical error. 
  • Look at the emerging issues affecting indemnity such as new and extended primary care roles, corporate and entity liabilities and indemnifying healthcare staff shared between organisations.

Caroline studied medicine at the University of Sheffield then worked as a GP in Cheshire before joining the MDU in 2006. Whilst working at the MDU, Caroline obtained her LLM in Legal Aspects of Medical Practice and is currently studying for an MBA.

Mike has been a medico-legal adviser at the MDU for over 15 years and latterly as head of advisory services. He is the MDU's Responsible Officer. He was a member of the Faculty of Forensic and Legal Medicine's academic committee and was an examiner for the MFFLM until 2014. He was Treasurer of the FFLM from 2011 to 2015. He has published many articles on medico-legal matters in various medical journals and papers in UK and Ireland and had published a chapter in a book. He has a significant amount of experience in teaching and assessing knowledge in medico-legal subjects.
