NHS England winter indemnity scheme terms and conditions

  1. Your application form can only be used to add additional out of hours (OOH) or extended access sessions undertaken for the named provider(s) between 1 October 2018 and 31 March 2019.
  2. You should continue to pay your normal MDU subscription for your routine work. Under this scheme, the NHS will only fund the cost of your indemnity for agreed additional OOH and extended access sessions undertaken between 1 October 2018 and 31 March 2019.
  3. You must have been authorised by NHS England, your CCG or your NHS OOH provider to apply for additional sessions under this scheme.
  4. You must have received confirmation from an OOH provider that you are needed to work additional sessions beyond your usual commitment.
  5. In order to apply for OOH or extended access sessions to be added to your MDU membership record, then under this scheme you must have otherwise been responsible for your own indemnity costs for this work. If, for example, the OOH provider offers indemnity for your work through another indemnity scheme (NHS indemnity or their own corporate indemnity), then there is no need to seek additional indemnity under this scheme.
  6. Additional funded sessions for an OOH provider are not available for members where other sessions undertaken for that provider are indemnified elsewhere (either by the provider or through another indemnifier).
  7. Subscription payments related to additional sessions will be paid for by NHS England, as agreed by them under the Winter Indemnity Scheme 2018/9. To process our reimbursement from NHS England, we will share with them your name and the information you have provided to us on your application form. By submitting an application form, you understand that your information will be shared securely with NHS England for this purpose.
  8. With your application, you confirm that NHS England can audit payments made under this scheme and can take steps to verify with OOH providers that additional sessional commitments have been delivered.
  9. In addition to completing an application form, you must keep a record of the additional OOH and extended access sessions worked under the scheme. Your record should include the date and time of the session and the provider you worked for. To validate your application, you will be required to submit your record to us at the end of the scheme.
  10. You must apply for additional OOH indemnity before any work is carried out. Your application to add additional OOH or extended access sessions to your MDU membership record is at the discretion of the MDU Board of Management and is in accordance with the MDU's Memorandum & Articles of Association. We will contact you to confirm if your application for additional OOH or extended access sessions has been successful.
  11. If your application to add additional OOH or extended access sessions to your MDU membership is successful and, for any reason, payment is not received from NHS England, we will contact you for payment directly.
  12. If payment is not received for the additional sessions then will remove the additional sessions from your membership record and access to MDU benefits of membership will not be available for these sessions worked.
