Lasting power of attorney, deputies and the Court of Protection

This short e-learning course covers what's meant by a lasting power of attorney (LPA), it's implications, and how it fits in the Mental Capacity Act 2005 framework. It also considers the related topics of deputies, the Office of the Public Guardian (OPG) and the Court of Protection (CoP).

The legislation, organisations, and case law relates to England and Wales.

This module covers:

  • types of LPA, why it's important for health staff to clarify what type of LPA is being relied upon, and what is and isn't covered by it
  • practical aspects of making and using LPAs that are helpful for clinicians to be familiar with
  • situations where an attorney can act in isolation, but where they will be unable to make a health decision for the donor
  • the roles of the OPG and the CoP
  • types of deputies and their responsibilities
  • scenarios to see how these legal mechanisms can work in real life.

Estimated completion time is 20 minutes.

You don't need to finish the course all at once – you can save your progress and pick up where you left off whenever it's convenient.
