Do I have a statutory duty of candour?

15 December 2016

All organisations registered with CQC in England must comply with the statutory duty of candour. It applies to organisations rather than individual doctors, however individuals still have an ethical and professional duty to be honest and open with patients when something goes wrong. It is expected that an organisation's staff cooperate to ensure its obligations under the statutory duty of candour are met.

This guidance was correct at publication on 15/12/2016. It is intended as general guidance for members only. If you are a member and need specific advice relating to your own circumstances, please contact one of our advisers.
